Terms of Service – Evolution Photo Booths

Welcome to Evolution Photo Booths (“we,” “us,” or “our”). By accessing evolutionphotobooths.com (the “Site”), booking a photo booth, or using any of our services (collectively, the “Services”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Site or Services.
1. Use of Services
- Eligibility: You must be 18+ or have parental consent.
- Booking & Payment: All bookings require a signed contract and non-refundable retainer (typically 50%). Full payment is due 14 days before the event unless otherwise agreed.
- Cancellations:
- More than 90 days before event: Refund of any payments made beyond the retainer, minus a $100 administrative fee.
- 30 days or less before event: No refund of retainer; any payments made beyond the retainer may be applied as a credit toward a future booking (valid for 12 months from original event date).
- Taxes & Fees: All prices exclude applicable Georgia sales tax (7% state + local rates), which will be added to invoices.
- Late Payments: Payments not received by due date accrue 1.5% monthly interest. We may pursue collection costs if unpaid after 30 days.
2. Event Responsibilities
- Venue Access: Client must provide:
- Power (110V, 15A dedicated circuit within 25 ft)
- Level ground
- Access starting 2 hours before the event for setup
- 1 hour after the event for tear-down
- Supervision: An attendant is provided; client remains responsible for guest behavior and compliance with venue rules.
- Props & Equipment: Intentional damage to props, backdrops, or booth will be charged at replacement cost + labor ($75/hr).
- Outdoor Events: Client must provide a weather contingency (e.g., tent). We are not liable for weather-related disruptions beyond force majeure.
3. Photo & Video Rights
- Ownership: We retain copyright to all images and videos.
- License to Client: Unlimited personal, non-commercial use. Commercial use requires written permission.
- Digital Delivery: Files delivered via secure link within 7 days post-event. Physical prints included per package; extras at $2 each.
- Marketing Use: We may use non-identifiable photos for promotion unless you opt out in writing (email [email protected] — no penalty).
4. Privacy & Data
- Photos are stored securely for 6 months, then permanently deleted unless you purchase extended storage.

5. Liability & Insurance
- Limit of Liability: Our maximum liability is the total fee paid for the booking.
- Insurance: We carry $1M general liability. For events with >250 guests, client must add us as additional insured on their policy.
6. Force Majeure
We are not liable for failure to perform due to acts of God, pandemics, venue closure, power failure, or other events beyond our control.
7. Dispute Resolution
- Disputes will first be resolved through good-faith negotiation.
- Claims under $10,000: Binding arbitration in Fulton County, GA under American Arbitration Association (AAA) rules.
- Claims $10,000 or more: Litigated in Georgia state court, Fulton County.
- No class actions.
8. Governing Law
These Terms are governed by the laws of the State of Georgia. Exclusive venue: Fulton County.
9. Changes to Terms
We may update these Terms. Continued use after posting constitutes acceptance. We will notify you of material changes via email or site banner.
10. Entire Agreement & Severability
These Terms, together with your signed booking contract, form the entire agreement. No oral modifications. If any provision is invalid, the remainder remains enforceable.
